Protect Our Lakes (Oakfield folks) v. Evergreen Wind II, LLC (First Wind)
Oral Arguments
Thursday, Feb. 12, 2015
11 am
Federal District Court of Maine
Margaret Chase Smith Federal Building & Courthouse
202 Harlow Street
Bangor, ME 04401

The federal court usually starts very promptly so you should be there by a bit before 11 am.

This is a federal appeal, not a state appeal. To date, only Kibby II and the Oakfield projects require a federal permit from the Army Corps of Engineers, because the construction, the transmission lines, will cross navigable waters of the U.S.
Our appeal is under the Endangered Species Act (ESA), a federal law. We argue that the government failed to adequately assess whether the construction would “take” Atlantic Salmon, which are a listed species under the ESA, and we are asking the court to send the matter back to the Corps, who would then have to request the US Fish and Wildlife Service to do an adequate assessment.

Timing: Each attorney (3) will have five minutes to speak and then Judge Levy will ask 15 minutes of questions for each of them. So the entire process will be about an hour. Judge Levy used to be on the Law Court so he has heard numerous wind appeals. But this will be the first time he is hearing ESA arguments.

Hope to see anyone that can make it to Bangor on Thursday.

I doubt the News Media will follow. However if possible, have someone video outside the Federal Courthouse. I was not allowed to video inside on the Lac Megantic issue when MMA went bankrupt.

Have people with signs for the video, then post it on YouTube, then mention it in the press with LTE's or other forums.

Wish I could be there, but I will be in Augusta, recording.

Thanks so much for the informative update! It is good to know what the issues are so others can add suggestions before the case is heard! Would be nice if a news team was on hand to interview a few people carrying signs! This is another change to inform the public that these projects are being rubber stamped with little thoughts about the future of the site and the short terms distraction of the area for electricity that is not needed!  Lenny Murphy

Maine Center For Public Interest Reporting – Three Part Series: A CRITICAL LOOK AT MAINE’S WIND ACT

******** IF LINKS BELOW DON'T WORK, GOOGLE THEM*********

(excerpts) From Part 1 – On Maine’s Wind Law “Once the committee passed the wind energy bill on to the full House and Senate, lawmakers there didn’t even debate it. They passed it unanimously and with no discussion. House Majority Leader Hannah Pingree, a Democrat from North Haven, says legislators probably didn’t know how many turbines would be constructed in Maine if the law’s goals were met." . – Maine Center for Public Interest Reporting, August 2010 https://www.pinetreewatchdog.org/wind-power-bandwagon-hits-bumps-in-the-road-3/From Part 2 – On Wind and Oil Yet using wind energy doesn’t lower dependence on imported foreign oil. That’s because the majority of imported oil in Maine is used for heating and transportation. And switching our dependence from foreign oil to Maine-produced electricity isn’t likely to happen very soon, says Bartlett. “Right now, people can’t switch to electric cars and heating – if they did, we’d be in trouble.” So was one of the fundamental premises of the task force false, or at least misleading?" https://www.pinetreewatchdog.org/wind-swept-task-force-set-the-rules/From Part 3 – On Wind-Required New Transmission Lines Finally, the building of enormous, high-voltage transmission lines that the regional electricity system operator says are required to move substantial amounts of wind power to markets south of Maine was never even discussed by the task force – an omission that Mills said will come to haunt the state.“If you try to put 2,500 or 3,000 megawatts in northern or eastern Maine – oh, my god, try to build the transmission!” said Mills. “It’s not just the towers, it’s the lines – that’s when I begin to think that the goal is a little farfetched.” https://www.pinetreewatchdog.org/flaws-in-bill-like-skating-with-dull-skates/
