The Administrative Procedure Act (APA) is a foundational U.S. law that ensures federal agencies create and enforce rules fairly and transparently, requiring public notice. This raises a question of whether the administration or agency could reissue an order for offshore wind with public notice and input.

The lawsuit was initiated in New York by New York Attorney General Letitia James initiated the multistate lawsuit. James claims President Trump is “illegitimate.”

There have been hundreds of lawsuits and restraining orders from dozens of lower court judges. Reliable sources indicate the December 8 court decision is appealable.

The Trump administration has been against offshore wind and has made efforts to block projects through various means, as offshore wind is an intermittent power source. There are national security concerns that large offshore wind farms interfere with military radar. Since 2016, whale deaths have followed the construction of offshore wind.
On November 4, 2025, a New York federal judge ruled that the Bureau of Ocean Energy Management can review and reconsider its approval for the SouthCoast Wind project. Federal regulators on December 2, 2025, filed a motion asking a court to remand the approval of the New England Wind construction plan back to the Bureau of Ocean Energy Management (BOEM) for reconsideration.
The lower federal courts' rulings appear to be based on political ideology, while cases appealed to the Supreme Court have an almost ninety percent win rate.

Investors have pulled out of or canceled numerous offshore wind projects due to the Trump administration's energy policies and economic uncertainty.
