Falmouth No Brief Filed At October 2, 2018, Wind Turbine Trial



August 29, 2018, the Massachusetts Appeals Court sent the Town of Falmouth a warning they had not filed a brief for the October 2, 2018 wind turbine appeal trial and if Falmouth does not file a brief the trial goes forward.

On September 7, 2018, Town Attorney Frank Duffy responded re: "do not intend to file a brief"

On July 10, 2017, Susan Moran, the chairwoman of the Board of Selectmen, said:"It's time to put the matter behind us and move forward." .The judge denied the appeal brought by Falmouth selectmen against the Zoning Board of Appeals. The Falmouth Zoning Board of Appeals had found the turbines to be a "nuisance."

During 2012 the time of the Massachusetts wind health impact study it was assumed commercial wind turbines had a manufacturers specification of a maximum output of 90 decibels.

The Town of Falmouth hid emails, maps and a letter dated August 2010 that the Falmouth wind turbines generate a chest pounding 110 decibels.

"The Town has previously been provided with the Octave Band Data / Sound performance for the V82 turbine. This shows that the turbine normally operates at 103.2dB but the manufacturer has also stated that it may produce up to 110dB under certain circumstances. "

3. Infrasound refers to vibrations with frequencies below 20 Hz. Infrasound at amplitudes over 100–110 dB can be heard and felt. Research has shown that vibrations below these amplitudes are not felt. The highest infrasound levels that have been measured near turbines and reported in the literature near turbines are under 90 dB at 5 Hz and lower at higher frequencies for locations as close as 100 m.
