Eminent Domain and the Northern Maine Renewable Energy Development Program

Perhaps not since Governor Baldacci's 2008 rotten and corruptly passed special interest legislation known as Maine's "Expedited Wind Law", has there been such a rotten, totalitarian and sweeping insult brought upon Maine by its government as the power corridor that would run from Aroostook County through central Maine. Aside from trampling the lives and rights of central Maine residents, this power line would open up Aroostook and Penobscot counties for a massive new wave of bullsh_t wind projects. As wind power is failing the world over and people everywhere are finally awakening to the incredible scam that it is, the powers that be in Maine are rushing to get this project in as they know time is running out.

Aside from its huge potential impact to transform large parts of Maine in a very negative way and its totalitarian nature just like those of the Expedited Wind Law, it is also remarkably similar to said wind law in that one of the chief beneficiaries of this heinous project is Longroad Energy whose "King Pine" wind project in Aroostook would connect to the power line. Without the power line, King Pine is dead. So just why is this remarkably similar to the Expedited Wind Law? Well how about because the chief beneficiary of Baldacci's Expedited Wind Law was a company named First Wind and Longroad Energy's management is basically the same crew that ran First Wind. See the familiar faces here.

Eminent Domain and the Northern Maine Renewable Energy Development Program

At least four different bill requests all relate to the use of eminent domain related to the Northern Maine Renewable Energy Development Program, which is home to the latest transmission line proposed to run through northern Maine. After the project received initial approval and its backers worked to finalize exactly where the line will run, affected property owners have called on their lawmakers to throw a wrench in the works and save their property from seizure.

Considering lawmakers on both sides of the aisle have proposed prohibiting the use of eminent domain for the project, or developing alternative pathways for this specific transmission line, it will be interesting to see what rises to the top and whether any of these proposals will be green-lighted for debate in the Second Session......

I've spoken with Tanya Blanchard (Preserve Rural Maine) from Thorndike re eminenet domain vs town ordinance. I do not believe they have engaged with legal counsel to determine the legal standing necessary (if it exists) to  withstand the state's challenge using ED to overide the local ordiance - a moratorium is not sufficient IMO. The courts will be involved and we know how they work after the NECEC disaster. Tough sledding ahead. I expect Troy Jackson to gin up a bill to deny ordinances due to the threat of climate change or some other bs.

Please read this passage from the law enacted for the "Northern Maine Renewable Energy Development Program"

"The commission, the Office of the Public Advocate and the Office of the Attorney General may, separately or in combination, obtain any technical or legal assistance necessary to ensure regional and federal interconnection and grid reliability standards are not employed directly or indirectly to discourage the development of the renewable energy resources of northern Maine under the program."

Maine Center For Public Interest Reporting – Three Part Series: A CRITICAL LOOK AT MAINE’S WIND ACT

(excerpts) From Part 1 – On Maine’s Wind Law “Once the committee passed the wind energy bill on to the full House and Senate, lawmakers there didn’t even debate it. They passed it unanimously and with no discussion. House Majority Leader Hannah Pingree, a Democrat from North Haven, says legislators probably didn’t know how many turbines would be constructed in Maine if the law’s goals were met." . – Maine Center for Public Interest Reporting, August 2010 https://www.pinetreewatchdog.org/wind-power-bandwagon-hits-bumps-in-the-road-3/From Part 2 – On Wind and Oil Yet using wind energy doesn’t lower dependence on imported foreign oil. That’s because the majority of imported oil in Maine is used for heating and transportation. And switching our dependence from foreign oil to Maine-produced electricity isn’t likely to happen very soon, says Bartlett. “Right now, people can’t switch to electric cars and heating – if they did, we’d be in trouble.” So was one of the fundamental premises of the task force false, or at least misleading?" https://www.pinetreewatchdog.org/wind-swept-task-force-set-the-rules/From Part 3 – On Wind-Required New Transmission Lines Finally, the building of enormous, high-voltage transmission lines that the regional electricity system operator says are required to move substantial amounts of wind power to markets south of Maine was never even discussed by the task force – an omission that Mills said will come to haunt the state.“If you try to put 2,500 or 3,000 megawatts in northern or eastern Maine – oh, my god, try to build the transmission!” said Mills. “It’s not just the towers, it’s the lines – that’s when I begin to think that the goal is a little farfetched.” https://www.pinetreewatchdog.org/flaws-in-bill-like-skating-with-dull-skates/
