BOEM has failed to address critical deficiencies in the Section 106 process, including:

  • Inadequate mitigation for the adverse visual effects on the Nantucket Historic District National Historic Landmark (NHL).
  • No legitimate plan to address future turbine failures, which could harm beaches and environment.
  • Insufficient decommissioning funding is needed to ensure the timely removal of turbines at the end of their useful life.
  • .

Despite these serious concerns, BOEM has only proposed $150,000 for historic property and archaeological surveys that the Town has not requested. This is an inadequate response that fails to meet the standards of meaningful mitigation under the National Historic Preservation Act (NHPA).

Please note: This document reflects the status of NHPA Section 106 information and consultations as of October 29, 2024, and has mostly recently been revised based on Tribal Nation and consulting party feedback received during an NHPA review and comment period held from July 1–31, 2024.

The Bureau of Ocean Energy Management (BOEM) has made a Finding of Adverse Effect under Section 106 of the National Historic Preservation Act (NHPA) pursuant to 36 Code of Federal Regulations (CFR) 800.5 for the undertaking, defined as the construction, installation, operations and maintenance (O&M), and conceptual decommissioning of the SouthCoast Wind Project (Project), as described in the SouthCoast Wind Energy, LLC (SouthCoast Wind) Construction and Operations Plan (COP) (SouthCoast Wind 2024). The Project would have adverse effects on historic properties. As defined in 36 CFR 800.16(l)(1), the term historic property means “any prehistoric or historic district, site, building, structure, or object included in, or eligible for inclusion in, the National Register of Historic Places [NRHP; National Register] maintained by the Secretary of the Interior.” The term historic property also includes National Historic Landmarks (NHLs) as well as sites of traditional religious and cultural importance to Tribal Nations that meet National Register criteria.

BOEM finds that the undertaking would adversely affect the following historic properties: 
.
• One marine archaeological resource (Table I-5; Section I.3.1.1, Assessment of Effects on Historic Properties in the Marine APE). 
.
• Two ancient submerged landform features (ASLFs) with potential or known archaeological or traditional cultural place (TCP) significance (Table I-7; Section I.3.1.1, Assessment of Effects on Historic Properties in the Marine APE). 
.
• Two terrestrial archaeological resources (Table I-8; Section I.3.1.2, Assessment of Effects on Historic Properties in the Terrestrial APE). 
.
• Two TCPs: Chappaquiddick Island and Nantucket Sound (Section I.3.1.1, Assessment of Effects on Historic Properties in the Marine APE; Section I.3.1.3, Assessment of Effects on Historic Properties in the Visual APE).

• Two aboveground historic properties:the Nantucket Historic District NHL and Oak Grove Cemetery (Section I.3.1.3, Assessment of Effects on Historic Properties in the Visual APE).

Dear Ms. Baker and Ms. Crawford:

We write on behalf of the Town of Nantucket (“the Town”). Our comments address BOEM’s revised documents and Draft Memorandum of Agreement for SouthCoast Wind. Insofar as BOEM has not considered or resolved the Town’s concerns about SouthCoast Wind, the Town restates its previous objections and incorporates those by reference. The Town continues to object to BOEM’s lack of good faith in disregarding the Town’s concerns. Town residents remain especially concerned about the cumulative impacts of SouthCoast Wind and all other wind farms.

BOEM’s “Draft Historic Properties Treatment Plan for Nantucket Historic District” is an absurd proposal. 
.
Mitigation must offset adverse effects to be meaningful and BOEM’s proposal falls far short of offsetting unavoidable adverse effects. As we have already explained, historic property and archaeological “surveys” have not been requested, and fail to offset the adverse effects to historic properties that SouthCoast will cause. Furthermore, we point out the futility of BOEM meeting with consulting parties at this time—including the Town—about proposed mitigation when information about impacts on the Nantucket Historic District from the Vineyard Wind 1 turbine failure, including its beaches, which are part of the National Historic Landmark designation, are not yet known because the Bureau of Safety and Environmental Enforcement (BSEE) has not completed its investigation of the failure and its consequences. BOEM should also reassess the accuracy of SouthCoast’s visual simulations given that the visibility of wind turbines, associated structures, and lighting is much greater than expected. The Town would welcome the opportunity to discuss these issues in detail with BOEM after BOEM shares the results of BSEE’s investigation with the Town and other consulting parties
