Anyhow Mike, the situation in Falmouth is hugely complicated, but the Zoning Board of Appeals is not the party deserving of a lawsuit.

In fact the ZBA is the subject of litigation by the party most culpable in all this, the Town of Falmouth.

Is the Town's culpability mostly ignorance rather than deliberate malfeasance? Ten years ago, maybe.

But the partners in all this are the ratepayer surcharge-funded and RGGI-funded, and ARRA funded state agencies who limit rectification of hsrm to neighbors are at the same time as offering partial relief contingent on continuing daytime operations. They bought the turbines, they paid well over $400,000 for a process to find the best way forward in Falmouth, and other towns where they have offerred huge incentives with virtually no vetting process for the projects.

Slam the US fed govt today as you will, but the feds would have done much more thorough vetting if this was a direct application by the Town of Falmouth for a federal low interest loan on this very small project causing harm to so many people.

It seems the zoning board is willfully negligent. I hope they can be sued for damages as individuals as well as sued as a town entity
