Honorable Chairman Thibodeau and Fitts and members of the EUT committee,
 
Tomorrow you will be  called  upon to vote on Rep Fitts amendment to LD 1366 .  I urge you to vote the  amendment down as  it will not solve any of the problems brought to you at the  public  hearings.  I attended two days of public hearings and  three working sessions.   It is  quite evident that through your questions, through the open admission by the industry and NRCM of current wind turbine related problems, and  of course  through the  two days  of  testimonies from citizens suffering from the "unintended consequences" of wind turbine noise, flicker, and visual impacts,  the case  has  been made  that LD 2283 was  an unfair, un-scientific, and undemocratic law that clearly needs  correction. This is simply inescapable and inexorable to the legislature and to  the public in the information age we currently live in.
 
Rep Fitts' amendment simply postpones potential solutions while  exposing large number of residents to problems by now well understood by the legislature, the  regulatory agencies, and the executive and judicial branches.  The complexity and the  enormity  of the  problems brought by the effects of the  Expedited Wind Law are clear to you I am convinced by now , and  this will become more  evident as the  turbines proliferate upon Maine landscape.
  
I would urge you to draft an amendment that includes:
  • Bans on proposals to operate turbines in Noise Reduced Operation to satisfy nighttime noise regulations.  Turbines setbacks should be sufficient to allow full power operations since no compliance protocol exists that would guarantee compliance with NRO on an ongoing basis.
  • Applying  the same " harmoniously fit " criteria  for the wind industry that applies to other development.
  • Ironclad guarantees to insure adequate provisions for decommissioning.
  • Proving adequate financial capacity  and protection citizen's property values.
