I challenge any member of State Government to provide facts to support the findings that made enactment of the Wind Energy Law an emergency act.
The Legislature finds that it is in the public interest to explore opportunities for and encourage the development, where appropriate, of wind energy production in the State in a manner that is consistent with all state and federal environmental standards and that achieves reliable, cost-effective, sustainable energy production on those sites in the State that will attract investment and permit the development of viable wind energy projects. The Legislature finds that the development of the wind energy potential in the State needs to be integrated into the existing energy supply and transmission systems in a way that achieves system reliability, total capital cost-effectiveness and optimum short-term and long-term benefits to Maine people. The Legislature finds it is in the public interest to encourage the construction and operation of community wind power generation facilities in the State. For the purposes of this chapter, "community wind power generation facility" means an electricity-generating facility at any one site with instantaneous generating nameplate capacity of not more than 10 megawatts that is powered entirely by wind energy. The Legislature also finds it is in the public interest to encourage wind energy research and the development of wind generation equipment manufacturing facilities in the State.

So all the wind projects are over 10mW which makes them in violation. "Community wind power generation facility"... it would seem to mean local community power generation for the local community, not for Mass. 500 miles away. The sale of energy out of state should also be in violation of the WEA. The wording could also be questioned, "consistent" with all state and fedaeal env. standards...clearly, the windsprawl is not. "Long term benefits"? Good grief the whole mess is out of sync with the reality of windsprawl.

Part of the emergency was to stop the tyranny of foreign oil!
Excerpt from an article written by the non-partisan Maine Center for Public Interest Reporting:
But Baldacci’s statement about dependence on imported fossil fuels – and many others he made both before and subsequently, including one reference to the “tyranny of foreign oil,” one reference to the need to “free ourselves from foreign oil” and two references to Maine’s “dependency on oil” in his final State of the State address – implicitly tied wind energy production to the goal of reducing the use of foreign oil, with its volatile prices as well as its documented contribution to climate change.
Yet using wind energy doesn’t lower dependence on imported foreign oil. That’s because the majority of imported oil in Maine is used for heating and transportation.
“Maine uses very little oil to produce electricity,” says Mark Isaacson, a dam owner, a founding member of the industry group Independent Energy Producers of Maine and an active player in the restructuring of Maine's electric utility industry.
John Kerry, the governor’s energy czar and a member of the task force, acknowledges that oil is used to fuel vehicles and to warm Maine buildings.
“Today we don’t use electricity to run our cars or heat our homes,” said Kerry in a recent interview.
And switching our dependence from foreign oil to Maine-produced electricity isn’t likely to happen very soon, says Bartlett. “Right now, people can’t switch to electric cars and heating – if they did, we’d be in trouble.”
So was one of the fundamental premises of the task force false, or at least misleading?
