Did Janet Mills Violate Another Federal Order

Usually, Central Maine Power and Versant requests for electric rate changes before the Maine Public Utilities Commission are months long deliberations including the same few stakeholders voicing their opinions. Really boring.

But this annual reconciliation case where CMP and Versant are asking for reimbursement for Net Energy Billing costs could get interesting thanks to a group that few of us ever consider. IECG ( Industrial Energy Consumer Group )
The IECG is a non-profit Maine trade association incorporated for the purpose of representing the interests of industrial energy consumers before proceedings of regulatory and legislative bodies.
To make a long story short, IECG states "Recovery of Above-Market NEB Tariff Rate Program Costs is Preempted and Prohibited. It is the position of IECG, and IECG argues in this proceeding, that the imposition on Versant and its ratepayers of NEB above-market costs associated with the Tariff Rate Program is in violation of federal preemption of state rate setting regarding wholesale transactions and therefore the above-market costs are not legitimate costs to be imposed on Versant, nor to be recovered and reconciled in stranded costs rates run through any rate setting mechanism administered by the Commission."
Interestingly, FERC ( Federal Energy Regulatory Commission) could become involved as they have supremacy over state agencies when rate setting issues arise, and President Trump is about to appoint a new commissioner to the five-member commission that is currently 2 Democrats and 2 Republicans.
The Maine Net Energy Billing Law passed by Maine Democrats is being challenged, finally. 
The Maine Energy, Utility and Technology(EUT) committee will soon address bills submitted to Repeal Net Energy Billing in whole or in part.
