Dear Mr. Fowler:

The Department has reviewed the Maine Supreme Judicial Court’s March 4, 2014 decision that vacated the Maine Public Utilities Commission approval of the 2012 joint venture between First Wind and Emera. Finding 3 of the Department’s October 7, 2013 condition compliance order (DEP #L-24572-24-H-C) for this project includes the determination that Emera will be making cash contributions for the proposed project. The Department has concluded that the Supreme Court’s decision has affected the proposed financing for the Oakfield II Wind project.

Therefore, the Department requests that First Wind submit a new condition compliance application describing how the proposed financial capacity materials will change based on the Supreme Court’s decision. We request that this information be submitted to the Department as soon as feasible so as to not cause any delays in construction. If additional materials are not received by the Department within 60 days of the date of this letter, the Department may consider other options.

One of the FoLL members offered a complete financial assessment to  LURC some time ago...gratis. He is a college professor and has been doing such studies for 20 years. His offer was ignored. It might have upset the preconceived fairy tales some of them had of their personal wind mythology. It would have been enlightening and FREE.

I think many in DEP,past and present,  have wanted to work for the people of Maine... Thank you ..great day. The banks that First Wind has done business with in the past are in a lot of trouble for criminal activity. It's almost over for the racket and the rackateers.

Dan ,in her  testimony to  the UET committee on May 9 th 2013 , DEP  Commissioner  Aho  expressed that :The department needs the flexibility to address emerging  issues which  would  be  best done through technical rulemaking ", " to allow the   department to undertake independent financial capacity review. " was  one of  those issues .

I wonder whether First Wind's solicitation on this $75 million discloses every single court case they and their scores of LLC's are involved with.

It would be nice if the Department would bring in some professionals to assess this companies financial viability .
