SIGNGATE CONTINUES - BUT SHOULD BE OVER SOON!
The saga of confiscation of anti-wind signs posted by the Moosehead Region Futures Committee in the Moosehead Lake area isn’t over yet but it should be soon. .A “concerned citizen” who contacted the Maine Attorney General’s office learned late yesterday that MDOT is seeking guidance from the AG’s Office.
A memorandum prepared by a public policy and legal consultant to Saving Maine, who has been supporting the Moosehead Region Futures Committee for the past three months, clearly shows that the recent US Supreme Court decision in Reed vs. Town of Gilbert applies to all states and communities. The ruling supports our claim that “the restrictions of the Maine Travelers Information Act are synonymous to those in the Town of Gilberts…. Signs can be regulated by size, materials, lighting and other content neutral-based factors, however to vary limitations on signs expressing different types of equally protected speech under the first amendment is no longer a constitutionally permissible practice, and therefore the Maine Traveler Information Act must be revised or repealed and replaced with a content-neutral substitute in order to conform with the law of the land.”
MDOT failed to revise its statute to reflect the Supreme Courts decision in a timely manner. Its removal of signs was unconstitutional and a violation of first amendment rights.
And the rest of the story can be told when MDOT responds to provide information requested under the Maine Freedom of Information Act – AND hopefully – who called to request the removal of the signs! Was it Luke Muzzy, Manager at Plum Creek as rumored around the Town of Greenville? We’ll keep you posted.
