Multiple states are suing the Trump administration because it failed to follow the Administrative Procedure Act.

On January 20, 2025, President Trump issued the wind turbine memorandum reviewing leasing and permits for wind projects.

A federal court hearing was held on November 18, 2025, in Boston.

A federal judge cannot directly determine how long the government takes to make a decision, as the government's decision-making process is an executive function. Federal judges cannot mandate when an executive branch agency must take action.

Federal judges can compel the executive branch to enforce a court decision, but they cannot directly force an executive branch agency to make an initial decision. In some cases, a judge can set deadlines for the parties involved in the case to make decisions or take certain actions, but this is separate from determining the government's initial decision-making timeline.

The Trump administration has hundreds of lawsuits, mostly from Blue states. Since January 20, 2025, the Supreme Court has issued 23 decisions on the shadow docket concerning administrative actions.

States argue that executive orders and agency actions, such as halting offshore leasing, pausing permitting, and imposing tariffs, lack the necessary reasoned justification and proper procedures required.

The Bureau of Ocean Energy Management review process takes around two years.

# Note      On November 4, 2025, in a separate case  1:25-cv-00906, a federal judge in Washington, D.C., ruled that the Trump administration may reconsider the approval of the SouthCoast Wind project. This decision sends the project's construction and operations plan back to the Bureau of Ocean Energy Management (BOEM) for re-evaluation..
